En esta comunidad podemos encontrar todos los artículos publicados en las revistas vigentes en el Portal de Revistas PUCP y tambien los artículos publicados en revistas que alguna vez figuraron en dicho portal pero que fueron retiradas por pérdida de continuidad.

Debemos resaltar que gracias a una paciente labor de recolección de números antigüos y digitalización de revistas impresas, la mayoría de estas revistas tienen su colección de artículos completa, llegando a sumar, a julio del 2021, un total de más de 20,400 artículos.

En esta comunidad de revistas la búsqueda y acceso es a cada artículo en particular, mientras que en el Portal de Revista las revistas se muestran por numero completo, con un indice de contenido. Si prefiere acceder de esta manera ingrese al Portal de Revistas PUCP .

Mención aparte merecen, por su importancia histórica y cultural el boletín del Instituto Riva Agüero y la Revista de la Universidad Católica, que siendo revistas descontinuadas, se muestran en este repositorio por números completos con su respectivo índice de contenido.

    Respuestas adaptativas, derecho a la salud y el límite del criterio de satisfacción: una reflexión y puesta en evidencia desde el sistema de salud peruano

    Some utilitarian readings present in bioethics emphasize the importance of satisfying people’s preferences as a significant criterion of justice. One of its recurring applications in the healthcare sector is through measuring the satisfaction of healthcare service users. However, little has been discussed in the healthcare and bioethics field regarding objections that this criterion has faced from the philosophy of law and political philosophy. One of these, known as the problem of adaptive responses, asserts that individuals, whether consciously or not, adjust their satisfaction based on what they can attain. Therefore, a cautious view of this criterion is recommended, especially when measuring the satisfaction of individuals facing deprivations. Greater caution should be exercised when it is applied to services that guarantee fundamental rights, such as the right to health. This article aims to discuss this issue and highlight its presence in the healthcare services of Peru. Specifically, after tentatively and briefly conceptualizing what an inappropriately adaptive response would be, this problem will be analyzed and evaluated based on certain components of the National Survey of User Satisfaction of Universal Health Assurance (Ensusalud) of 2014, 2015 and 2016, which are the only three surveys of this kind conducted in Peru to date and on a national scale. In more detail, the aim is to determine whether significant differences in satisfaction with their health insurance exist among users based on their income levels, considering the same degree of impact on their right to health. The processing and analysis of the database lead to the conclusion that these differences do indeed exist. Faced with a infringement on this right (for example, not receiving any medication at the pharmacy, taking more than ninety minutes to reach the facility, etc.), severe economically deprived users express higher levels of satisfaction with their insurance compared to users without economic deprivations. This provides indications to suspect that, in relation to the first group of users, there might indeed be a case of adaptive responses.

    La regulación del Cannabis Medicinal en el Perú

    The article develops the current regulatory framework for Medical Cannabis in Peru. At first, it presents and develops certain key concepts to understand the medicinal properties of Cannabis and its components. Subsequently, it analyzes the relationship between the fundamental right to health and its elements with Medical Cannabis. Then, it analyzes both its legal and regulatory framework and, finally, it analyzes its deficiencies and offers proposals to improve it from a regulatory perspective.

    Derecho a la salud y pandemia: análisis a la constitucionalidad del pasaporte sanitario

    The pandemic caused by COVID-19 has been a devastating period for humanity and its human rights. In particular, considering that it has triggered various events that have had a negative, concrete and direct impact on the rights of citizens.  Therefore, in this article, the author develops the right to health, its importance, and the obligation of all States to guarantee and protect this right.  More specifically, the author analyzes the implications that the pandemic has had on the right to health of the population worldwide. In addition, he explores the cases of Chile, France, Spain, and Peru in the implementation of the health passport. Following the previous line, it analyzes the recent sentences of the Constitutional Council of France and the Supreme Court of Spain, where they evaluate the constitutionality of the sanitary passport. Finally, from the perspective of the general standards of constitutional law shared by the legal systems, the author analyzes the constitutionality of the health passport.

    Perú: elecciones 2021 en el contexto de la pandemia de COVID-19

    The holding of the parliamentary and presidential elections in Peru during the pandemic caused by COVID-19 was a controversial issue, to the point that its suspension or postponement was put into debate, especially if we take into account the effects that could have generated both in the right to vote as in the right to health. In this context, various constitutionalists, academics and international organizations pointed out that it was necessary to strengthen democratic institutions by exercising the citizen's right to vote, but it was necessary to have biosafety protocols to avoid further contagion.  From an international perspective, there were successful cases in the implementation of the electoral process in 2020, South Korea being one of them as it used electronic voting, verifying, with subsequent tests, the low rate of contagion. The authors point out that this solution, in Peru, has been incorporated since 2010. However, it has not yet become widespread, which is why it could not be applied in the first and second electoral rounds in 2021. For this reason, in this article, the authors analyze the actions taken by the State in order to carry out the elections from the perspective of fundamental rights.

The author refers to the regulation in the Peruvian legal system and presents proposals that allow greater flexibility for workers, in order for the workers to fully develop.

    Potestad Sancionadora Administrativa en Materia de Salud

    En la primera parte del presente artículo se desarrollan conceptos y aspectos normativos del derecho a la salud, a fin de evidenciar la naturaleza de la injerencia del Estado en el ámbito de la salud y el contenido del derecho que se pretende proteger y restituir con el ejercicio de la potestad sancionadora administrativa; asimismo, se formula una breve reseña de la Reformade Salud en el Perú, emprendida con el paquete de decretos legislativos emitidos por el Ejecutivo, publicados entre el 12 de septiembre y el 07 de diciembre del año 2013, conforme a las facultades conferidas por el Legislativo mediante la Ley N° 30073, con la finalidad de exponer el contexto en el cual se confirió la potestad sancionadora en materia de salud a la Superintendencia Nacional de Salud (SUSALUD). En el aspecto central de la propuestase presenta el procedimiento administrativo sancionador de SUSALUD: Sus antecedentes, actores, estructura, infracciones, sanciones, medidas provisionales y medidas correctivas; finalmente, se dedican unas líneas a la transferencia de la competencia de proteger los derechos de los consumidores de servicios de salud de INDECOPI a SUSALUD.

    Responsabilidad social en la investigación con humanos

    Social responsibility in research with human beingsIt seems anachronistic to keep on talking of ethics and bioethics in a globalized culture. All ethics is based on a responsibility that acknowledges the value of the other because it forces an answer and this answer is supposed to be free. The exercise of freedom improves, grows, increases when limits are part of it. The possibilities of the answer are constructed by exchange when the limits act upon the behavior of the individual. In bioethics there is a strong tendency to associate responsibility with acts of individual relation. This neglects the strictly solidary character of responsibility. Freedom is conditioned by equality but much more by solidarity. Solidarity forces us to accept limits imposed to us by coexistence. Health is the space where this becomes relevant. Therefore it is necessary to think of social responsibility from a bioethics perspective based on human rights, especially on the right to health. This work does precisely that, focusing on research with human beings.

    La salud: Derecho Constitucional de carácter programático y operativo

    El derecho a la salud es un derecho universal de segunda generación clasificado en el conjunto de los derechos sociales, económicos y culturales de la humanidad siendo aceptado en el mundo por su carácter programático. A punto de llegar a los cien años de ese reconocimiento, su carácter de derecho operativo, exigible y tutelable o subjetivo constitucionalmente reconocido se ha venido consolidando gracias al desarrollo de la jurisprudencia de los tribunales constitucionales; posteriormente a ese fenómeno jurídico, en nuestro país, se regula su exigibilidad vía proceso de amparo en el Código Procesal Constitucional y se amplía su protección, en ambos ámbitos, con las facultades asignadas al órgano regulador y fiscalizador del sector salud a nivel nacional, de potestad administrativa sancionadora.
