The text examines the two methods of interpretation used in the American Common Law: textualism and contextualism. After looking at the parties’ preference for textualism, it highlights the reasons why it appears to be the most effective method. This method is more respectful of their wishes and is able to interpret the needs of the business world more effectively. The practical reality shows how the same parties can decide how to make the context relevant.

El texto examina los dos métodos de interpretación utilizados en el Common Law estadounidense: el textualismo y el contextualismo. Tras observar la preferencia de las partes por el textualismo, destaca las razones por las que parece ser el método más eficaz. Este método es más respetuoso con sus voluntades y es capaz de interpretar las necesidades del mundo empresarial con mayor eficacia. La realidad práctica muestra cómo las mismas partes pueden decidir cómo hacer que el contexto sea relevante.
