Resumen
En el presente artículo, el autor destaca la importancia de las opiniones del Organismo Supervisor de Contrataciones del Estado (OSCE) para los operadores de la Ley de Contrataciones del Estado (LCE) y, a través de algunas de estas, comenta respecto a aspectos importantes del procedimiento de solicitud de ampliación de plazo excepcional, regulada por la Directiva N° 005-2020-OSCE/CD, la cual fue creada con la finalidad de reactivar las obras contratadas bajo el ámbito de la LCE que quedaron paralizadas a consecuencia del Covid-19. Asimismo, explica brevemente las diferencias entre el procedimiento regulado por dicha directiva y el procedimiento regulado en la LCE.
Asimismo, analiza una resolución del Tribunal de Contrataciones del Estado (TCE) y, considerando disposiciones de la LCE y de la Ley de Arbitraje, determina que la referida Entidad se pronuncia sobre aspectos que son de competencia exclusiva de la jurisdicción arbitral, vulnerando el principio de no interferencia. Asimismo, se concluye, a partir de un acuerdo de Sala Plena del TCE, que dicho procedimiento administrativo sancionador debió suspenderse.
In this article, the author highlights the importance of the views of the State Contracting Supervisory Agency for the operators of the State Contracting Law and, through some of these, comments on important aspects of the procedure for requesting an exceptional term extension, regulated by Directive No. 005-2020-OSCE/CD, which was created with the aim of reactivating the works contracted under the State Contracting Court that were paralysed as a result of Covid-19. It also briefly explains the differences between the procedure regulated by that directive and the procedure regulated by the State Contracting Law. Likewise, it analyses a resolution of the State Contracting Court and, considering the provisions of the State Contracting Law and the Arbitration Law, it determines that the referred entity pronounces on aspects that are of exclusive competence of the arbitration jurisdiction, violating the principle of non-interference. Likewise, it is concluded, on the basis of an agreement of the Plenary Chamber of the State Contracting Court, that such administrative sanctioning procedure had need to be suspended.
