Abstract
El presente estudio efectúa un diagnóstico del conjunto de los modelos nacionales de negociación colectiva en Europa. Efectúa sobre todo una presentación de su evolución más reciente, detectando las posibles tendencias, su uniformidad y/o divergencia. Se ha intentado evitar una descripción aislada de la regulación de cada regulación nacional, pues se ha pretendido realizar un estudio transversal, que permita una comparación de cada una de las materias que integran dicha regulación: fuentes jurídicas, tipología, estructura y concurrencia, sujetos, procedimiento, eficacia jurídica, vigencia y duración, administración, control de la legalidad, así como contenido negocial. Ello nos ha permitido detectar hasta qué punto existen para cada aspecto grupos de sistemas nacionales, es decir modelos de negociación colectiva con señas de identidad comunes, con tendencias hacia la convergencia o hacia la divergencia.
This study makes a diagnosis of the national collective bargaining models in Europe. It mainly offers a presentation of its most recent evolution, detecting possible trends, its uniformity and/or differences. An attempt has been made to avoid an isolated description of each national regulation, since a transversal study is considered a better option, as it would allow to make an appropriate comparison among the matters that involve all the referred regulations: legal sources, typology, structure and concurrence, subjects, procedure, legal effectiveness, duration, administration, legality controls, as well as business content. This has allowed us to detect to what extent how many groups of existing national systems exist regarding any of these aspects, that is, collective bargaining models with common identity signs and similar tendencies towards convergence or divergence.
