Los regímenes patrimoniales del matrimonio y de la unión estable: Estado de la cuestión y perspectivas de reforma

Abstract

On the occasion of the Bicentennial of the Independence of Peru, which is presented as the great historical opportunity for legal operators to carry out a global review of legal institutions with a perspective of reform, a comprehensive examination of the regulation of marriage property regimes is carried out. and of the stable union; a task that is justified if it is considered that the current normative provision, contained in the 1984 Civil Code, responded to the postulates of the 1979 Constitution, which today is repealed; corresponding, therefore, to analyze it under the perspectives introduced by the 1993 Constitution and the developments of comparative law in this matter.

Con ocasión del Bicentenario de la Independencia del Perú, que se presenta como la gran oportunidad histórica para los operadores jurídicos de efectuar una revisión global de las instituciones jurídicas con perspectiva de reforma, se realiza un examen integral a la regulación de los regímenes patrimoniales del matrimonio y de la unión estable; tarea que se justifica si se considera que la actual previsión normativa, contenida en el Código Civil de 1984, respondió a los postulados de la Constitución de 1979, la que hoy se encuentra derogada; correspondiendo, por tanto, analizarla bajo las perspectivas introducidas por la Constitución de 1993 y los desarrollos del derecho comparado en esta materia.
