La (im)potencia del derecho frente a la corrupción

Abstract

This study on corruption begins by contextualising and offering definitions of a complex and multifaceted phenomenon in which ethics, politics and law converge. After considering the possibility of a new right to a corruption-free society, the regulation of transparency and the fight against corruption itself is addressed, mainly from the point of view of the Spanish legal system. The invisible transparency and the apparent fight against corruption give way to two forms of perception of the Law in the fight against corruption. The power and powerlessness of the Law thus turn out to be much less at odds with each other than one might at first assume. Finally, it is insisted not only that corruption and democracy areincompatible, but also that the fight against corruption has Civic Education as its corollary in the face of the unavoidable need to consider preventing it and combating it culturally.Este estudio sobre la corrupción comienza proponiéndose contextualizar y ofrecer definiciones acerca de un fenómeno complejo y poliédrico en el que convergen la ética, la política y el derecho. Tras plantear la posibilidad de estar ante un nuevo derecho a una sociedad libre de corrupción, se aborda la regulación de la transparencia y de la lucha contra la corrupción propiamente dicha, principalmente desde la óptica del ordenamiento jurídico español. La invisible transparencia y la aparente lucha contra la corrupción dan paso a dos formas de percepción del derecho frente a la corrupción. La potencia y la impotencia del derecho acaban resultando así dos vías mucho menos enfrentadas de lo que en un principio cabría suponer. Finalmente, se insiste no solo en que corrupción y democracia son incompatibles, sino también en que la lucha contra la corrupción tiene como corolario a la educación cívica ante la necesidad inaplazable de plantearse prevenirla y combatirla culturalmente.
