Regulación de la calidad migratoria y emisión de la visa nómada en el Perú. Impacto positivo y desafíos

Abstract

The advancement of technology and the transformation of work structures toward hybrid and remote models have driven the global rise of the digital nomad lifestyle. In response, various countries have chosen to implement specific migration regulations. In the case of Peru, Legislative Decree No. 1582 regulates the new migratory status of “digital nomad,” aimed at foreign nationals who work remotely using digital tools, provided that their employment relationship is with a company based outside the country.This article introduces the phenomenon of digital nomadism, outlines the profile of the digital nomad, presents a brief comparative study, and based on this, offers an analysis of the positive impact of this migratory category and its main challenges.

El avance de la tecnología y la transformación de los esquemas laborales hacia modelos híbridos y remotos, han impulsado el crecimiento del estilo de vida de los nómadas digitales a nivel mundial. A modo de respuesta, distintos países han optado por trabajar regulaciones migratorias específicas. En el caso del Perú, el Decreto Legislativo N.° 1582 regula la nueva calidad migratoria de «nómada digital» dirigida a ciudadanos extranjeros que trabajen de manera remota usando herramientas digitales, bajo la condición de que su vínculo laboral sea subordinado a una empresa residente fuera del país. Este artículo presenta al fenómeno del nomadismo digital, trabaja en el perfil del nómada digital, realiza un breve estudio comparativo y a partir de ello elabora un análisis del impacto positivo de la figura y sus principales desafíos.
