Llegó la ruptura: analizando los divorcios de matrimonios del mismo sexo en España

Abstract

Law 13/2005 meant the recognition of gay marriage after decades of waiting and attempts to regulate these couples by different Autonomous Communities. This fact made Spain one of the pioneer countries in recognizing this type of marriage. This article addresses the evolution of the dissolution of same-sex marriages as the degree of conflict between them. To do this, quantitative methodology is used through the secondary data review technique, using both the Natural Population Movement (NPM) and the Nullity, Separation and Divorce Statistics (INE). The main conclusions, it is necessary to highlight the gradual and uninterrupted rise in the dissolution of same-sex marriages until 2014. As of this date, the data show greater variability. On the other hand, it is significant that the breakups have a high degree of consensus, the duration of the bonds has been increasing and the presence of children in divorce.

La Ley 13/2005 supuso el reconocimiento de matrimonios compuestos por personas del mismo sexo tras distintos intentos de regulación de estas parejas, por algunas Comunidades Autónomas (CC.AA.). Este hecho, convirtió a España en uno de los países pioneros en reconocer este tipo de matrimonios. El presente artículo aborda la evolución de los divorcios de matrimonios de personas del mismo sexo, así como algunas características de estos. Para ello, se hace uso de metodología cuantitativa mediante la técnica de análisis de datos secundarios. Las bases de datos han sido el Movimiento Natural de Población (MNP) así como la Estadística de Nulidades, Separaciones y Divorcios (ENSD). De las conclusiones hay que destacar el ascenso paulatino e ininterrumpido de las disoluciones de los matrimonios del mismo sexo hasta el año 2014. A partir de esta fecha, los datos presentan mayor variabilidad. Por otra parte, es significativo que las rupturas tienen alto grado de consenso, la duración de los enlaces ha ido aumentando y la presencia de hijos en los procesos de divorcio es cada vez más frecuente.
