La polémica figura del “autoplagio” ¿Sería pertinente regularla legislativamente en el Perú?

Abstract

“Self-plagiarism” is a figure provided in the academic and scientific field to describe the behavior of authors consisting of “plagiarizing themselves”, something that would occur when an author publishes a work whose content coincides with that of another work by the same author previously published, without citing the previous work. Unlike plagiarism, self-plagiarism is not regulated by law, it is only provided for by regulation through guidelines from scientific journals and educational institutions. In this regard, the possibility of legislatively regulating self-plagiarism within the copyright regulations is proposed in this paper, so that authors have a clear regulatory framework that facilitates their research and publication task.El “autoplagio” es una figura prevista en el ámbito académico y científico para describir la conducta de los autores consistente en “plagiarse a sí mismos”, algo que ocurriría cuando un autor publica una obra cuyo contenido coincide con el de otro trabajo del mismo autor ya publicado anteriormente, sin citar la obra anterior. A diferencia del plagio, el autoplagio no está regulado legislativamente, solo está previsto reglamentariamente a través de directrices de revistas científicas e instituciones educativas. Al respecto, se plantea en el presente artículo la posibilidad de regular legislativamente el autoplagio dentro de la normativa sobre derechos de autor, a fin de que los autores cuenten con un marco normativo claro que facilite su tarea de investigación y publicación.
