Abstract
En el presente artículo se desarrolla un marco conceptual de lo que constituye Prueba indiciaria, su compatibilidad con el derecho a la presunción de inocencia, los requisitos del razonamiento lógico que debe seguir una sentencia judicial que se fundamente en prueba indiciaria, la clasificación de indicios, y el porqué es tan relevante la prueba indiciaria en el marco de un proceso penal.
In this article a conceptual framework of what constitutes circumstantial evidence is developed, its compatibility with the right to the presumption of innocence, requirements of logical reasoning to follow a court order that is based on circumstantial evidence, classification of evidence, and why it is so relevant circumstantial evidence in the context of criminal process.
