El principio de fe pública registral hoy: ¿todavía existe?

Abstract

The principle of public faith in the registry is back on everyone’s lips as a result of the ruling of the third party in good faith of the Peruvian Constitutional Court. Although its constitutionality was reaffirmed, the principle of public faith in the registry underwent a huge change that raises the question: does the principle of public faith in the registry still exist?In this article, the author summarizes the uneven path of the principle of public faith in the registry in Peru and its conception today, recalling its theoretical and practical basis, and criticizes its current conception.El principio de fe pública registral ha vuelto a estar en boca de todos a raíz de la sentencia del tercero de buena fe del Tribunal Constitucional peruano. Si bien se reafirmó su constitucionalidad, el principio de fe pública registral sufrió un enorme cambio que da pie a la pregunta ¿todavía existe el principio de fe pública registral? En el presente artículo, el autor resume el accidentado recorrido del principio de fe pública registral en el Perú y su concepción al día de hoy, recordando su fundamento teórico y práctico, y realizando una crítica a su concepción actual.
