Abstract
El presente estudio tiene por objeto contribuir a la caracterización de la caducidad en el Derecho administrativo y, principalmente, de una de las manifestaciones de esta última: la caducidad del procedimiento administrativo sancionador o también llamada “caducidad-perención”. Para ello, este artículo parte por advertir la falta de univocidad en la definición de la caducidad en el Derecho administrativo con la finalidad de poder entender sus distintas manifestaciones y, seguidamente, resaltar las particularidades que definen a la caducidad-perención. Luego de ello, se analizan los principales elementos que definen a la caducidad-perención, su ámbito de aplicación, la posibilidad de ampliar el mismo y los efectos que desencadena de acuerdo al desarrollo que ha recibido en el TUO LPAG.
The present study aims to contribute to the characterization of the expiration in administrative law and, mainly, one of the manifestations of the latter: the expiration of the sanctioning administrative procedure or also called “expiration-expire”. For this, this article starts by warning the lack of univocality in the definition of the expiration in the administrative law in order to understand its different manifestations and then highlight the particularities that define the expiry-perennial. After that, the main elements that define expiration-expire, its scope of application, the possibility of expanding it and the effects it triggers according to the development it has received in TUO LPAG are analyzed.
