Abstract
El trabajo, partiendo de la distinción entre texto y norma, reflexiona sobre la evolución de la jurisprudencia vinculante en la justicia constitucional y ordinaria italiana, propone soluciones para que la Corte de Casación cumpla su misión institucional de garantizar la uniforme interpretación de la ley y como deberían aplicarse los precedentes respecto de normas procesales.
The work, on the basis of the distinction between text and norm, reflects on the evolution of binding jurisprudence in the Italian constitutional and ordinary justice, proposes solutions to allow the Court of Cassation to accomplish its mission of ensuring the uniform interpretation of the law and as should be applied the precedents with respect to procedural rules.
