Medidas cautelares en el arbitraje

Abstract

El arbitraje es un medio alternativo de resolución de conflictos cuya celeridad y eficiencia ha generado que su uso se extienda exponencialmente. Este trabajo discute la importancia de la tutela cautelar efectiva de las partes que han optado por someter sus controversias a arbitraje, con especial énfasis en las particularidades que caracterizan a las medidas cautelares otorgadas en sede arbitral, y una figura de reciente aparición: el árbitro de emergencia.

Arbitration is an alternative mechanism of dispute resolution whose efficiency and speed has generated its extension exponentially. This work discusses the importance of the effective precautionary measure effective of the parties that have chosen to submit their disputes to arbitration, with special emphasis on the particularities that characterize the precautionary measures granted at the arbitration site, and a figure of recent appearance: the emergency arbitrator.
