Resumen
Hace mucho tiempo que la tecnología de la información ha ingresado al ámbito del trabajo, producto de esta incursión aparece pocos años atrás el smart working en Italia, como un modo de ejecución del contrato de trabajo subordinado, que como toda novedad ha ocasionado grandes expectativas, pero también ha evidenciado puntos de controversia que poco a poco van esclareciéndose. Esta nueva herramienta de la contratación laboral busca, de manera directa e indirecta, renovar, actualizar y adaptar las históricas instituciones del Derecho del Trabajo a un mercado laboral cada vez más flexible, es así como el smart working busca convertirse en una importante innovación tecnológica dentro del contrato de trabajo, modificando conceptos que hasta hace algunas décadas parecían ser intocables.
It has long been introduced into the field of work. As a result, smart working appeared a few years ago in Italy as a mode of execution of the contract labour in a subordinate employment relationship. As with all novelties, this has given rise to great expectations, but it has also revealed points of controversy that are gradually becoming clearer. This new labour contracting tool aims, directly and indirectly, to renew, update and adapt the historical institutions of Labour Law to an increasingly flexible labour market. Smart working seeks to become an important technological innovation within the employment contract, modifying concepts that until a few decades ago seemed indisputable.
