El poder constituyente y la reforma de la constitución en la jurisprudencia del Tribunal Constitucional
Abstract
La democracia constitucional es un sistema político cuya finalidad es la protección de los derechos de las personas. En cada país, este sistema se individualiza en estructuras organizativas concretas (denominadas formas de gobierno o regímenes políticos) contenidas en su Constitución. Este instrumento normativo, además, contiene el reconocimiento de los derechos a ser protegidos mediante el funcionamiento de las instituciones constitucionales.
Debido a que la democracia constitucional es un sistema que expresa el autogobierno de las personas, uno de sus elementos fundamentales es el Poder Constituyente, es decir, la atribución que corresponde a los gobernados de elaborar la Constitución de su sociedad política. Esta Constitución puede ser objeto de modificaciones motivadas por los cambios que se producen en dicha sociedad. El instrumento para realizarlas es la Reforma Constitucional.
En el presente Cuaderno de Trabajo revisaremos el tratamiento que el Tribunal Constitucional peruano le ha brindado tanto al Poder Constituyente como a la Reforma Constitucional. Con este punto de partida, intentaremos una aproximación al significado de estos dos conceptos fundamentales del Derecho Constitucional.
