Un análisis histórico-jurídico de los múltiples regímenes de extranjería y nacionalidad vigentes en El Salvador

Abstract

The Salvadoran State, by virtue of the international principle of State sovereignty, submits the migratory flows of people both in and out of the country to the maximum control. All Salvadoran legal instruments of migration and aliens in force today are the result of this maximized control of the population. They are anachronistic legal norms and some of them even pre-constitutional, which do not respond to the current Salvadoran social reality. At the present, an Act is pending for the consolidation of all migration and foreign legislation.El Estado salvadoreño, en virtud del principio internacional de soberanía estatal, somete al máximo control los flujos migratorios de personas tanto de salida como de entrada en el país. Fruto de ese control maximizado son todos los instrumentos jurídicos salvadoreños de migración y extranjería que actualmente están en vigor. Son normas jurídicas anacrónicas y algunas de ellas preconstitucionales, que no responden a la realidad social salvadoreña del presente. Actualmente está pendiente de aprobación una Ley Especial que refunde toda la legislación de migración y extranjería.
