Abstract
Ha transcurrido más de dos años desde que el marco normativo aplicable a la minería ilegal y al proceso de formalización minera entró en vigencia. A la fecha, el Gobierno conoce las reales dimensiones del problema, sus causas, consecuencias y prioridades. Sin embargo, aun cuando el objetivo es justo y necesario, debido al laberinto jurídico con el que se ha regulado el tema, la figura del minero informal se ha convertido en el principal obstáculo para la comercialización de minerales en el ámbito de la minería a pequeña escala.
The legal framework applicable to the illegal mining and the mining formalization process is in force since more than two years. Currently, the Government knows the real dimensions of the matter, its causes, consequences and priorities. However, even when the goal is right and necessary, due to the legal maze which regulates this topic, the “informal miner” has become in the main obstacle for the commercialization of minerals in the Peruvian Small-Scale Mining.
