La regulación del contrato de explotación en los regímenes vigentes de formalización minera

Abstract

El autor, luego de describir y verificar los resultados de la ejecución de los dos procesos de formalización minera a nivel nacional en el Perú, analiza las características y efectos del contrato de explotación minera; y demuestra que la responsabilidad ambiental solidaria establecida en la Ley 27651 ha quedado tácitamente derogada por la responsabilidad ambiental individual prevista por el Decreto Legislativo 1105.The author, after describing and verifying the results of the execution of the two mining formalization processes at a national level in Peru, analyses the characteristics and effects of the mining exploitation contract; and proves that the joint environmental liability established in Law 27651 has been tacitly repealed by the individual environmental liability regulated by the Legislative Decree 1105.
