Neutralidad de Red en Perú: Una Retrospectiva

Abstract

Este artículo documenta la evolución de la regulación del Principio de Neutralidad de Red en el Derecho peruano durante la última década, a través de un estudio detallado de las diversas normas que han integrado su marco regulatorio. Desde sus orígenes casi accidentales hasta el reciente Reglamento publicado por OSIPTEL en 2016, este trabajo destaca la ausencia de un claro y consistente objetivo regulatorio detrás de estos esfuerzos.This paper documents the evolution of the Network Neutrality Principle regulation in Peruvian Law during the last decade, through a detailed study of the several laws that have built it. Since their almost accidental beginnings to the recently published Regulation by OSIPTEL in 2016, this work highlights the lack of a clear and consistent regulatory objective behind these efforts.
