En esta comunidad podemos encontrar todos los artículos publicados en las revistas vigentes en el Portal de Revistas PUCP y tambien los artículos publicados en revistas que alguna vez figuraron en dicho portal pero que fueron retiradas por pérdida de continuidad.

Debemos resaltar que gracias a una paciente labor de recolección de números antigüos y digitalización de revistas impresas, la mayoría de estas revistas tienen su colección de artículos completa, llegando a sumar, a julio del 2021, un total de más de 20,400 artículos.

En esta comunidad de revistas la búsqueda y acceso es a cada artículo en particular, mientras que en el Portal de Revista las revistas se muestran por numero completo, con un indice de contenido. Si prefiere acceder de esta manera ingrese al Portal de Revistas PUCP .

Mención aparte merecen, por su importancia histórica y cultural el boletín del Instituto Riva Agüero y la Revista de la Universidad Católica, que siendo revistas descontinuadas, se muestran en este repositorio por números completos con su respectivo índice de contenido.

    La regulación de los fármacos en las Leyes de Platón

    In the standard manuscript of the Laws the Parisinus Graecus 1807 of the 9th Century AD this dialogue is placed between the Minos and the Epinomis. While in the Minos the pupil refers to the diversity of rites and traditions that can be observed amongst different peoples, the Epinomis stresses the unity of the law. The regulation of symposia, the access to drugs, to intoxicating drinks and to medicine is a fundamental theme of the Laws. This is evident already from the composition of the dialogue, since this theme is discussed in its first books. The art of regulating communal life is shown as a technique that can be perfected through dialogue. Communal drinking can be beneficial, says the anonymous Athenian foreigner, since wine encourages citizens to sing, and through the confrontation with pleasure citizens are able to exercise temperance. Since the consumption of wine may also produce excesses and loss of constraint, its consumption should be regulated. The Athenian proposes a minimal age limit for wine drinking: 18 years old (Laws, 2.666a-e). The position of the Athenian foreigner concerning the regulation of drugs is a message that might be called “antiprohibitionist”, although not in the contemporary sense (individualist and liberal), but in the sense that an absolute prohibition of drug consumption for the citizens is not defended: the proposal is to allow its consumption, but under a legal and communitarian regulation.

    El problema del mal moral y del consentimiento en la violación sexual: un análisis filosófico

    This article addresses the problem of the moral wrong present in rape. To do so, it undertakes an analysis of John Gardner's proposal on the subject. Then, identifying what Gardner calls a pure case of rape, it explores the nature and characteristics of consent as a normative transformer. To this end, it addresses the discussion, within the philosophy of action, on what is the ontology of consent. Finally, and as a consequence of holding that consent is a mental state, some problems related to the knowledge of other people’s mental states, traditionally addressed as the problem of other minds in the philosophy of mind, are raised. Some consequences for the evidentiary analysis in cases of rape crimes are drawn from this analysis.

    Constitutionalizaton of Law’s different areas is a phenomenon gradually more ingrained in our cultural and legal framework. Maybe the best demonstration is the increasingly prominent role of the Constitutional Court (TC) – Constitution’s Supreme Interpreter – in defining and redefining concepts, rights and legal principles touching a range of subjects, from TaxLaw to Human Rights. This is relevant to understand the Law and its current effects whether it is valued positively or negatively.

    La presente tesis quiere destacar, en contra del positivismo, el arraigo esencial que el derecho guarda con el valor justicia. Para ello toma en consideración la moderna teoría de los valores -principalmente en su formulación scheleriana- conectándola con la vieja y rica noción de persona que aporta la tradición filosófica y jurídica del cristianismo, y que es el valor superior en cuanto desarrollo y lugar natural de encarnación de la esfera del espíritu. No se pretende analizar los distintos contenidos de las doctrinas sobre la justicia. Simplemente ponemos de relieve que el derecho únicamente puede fundamentarse en el orden axiológico y que sólo tal planteamiento le confiere carácter obligatorio.

    Habermas contra el hiperracionalismo: apuntes del debate Habermas-Luhmann a propósito del tópico marxista de la ideología

    This paper presents a revision of the way in which Jürgen Habermas returns to the critical tradition of Marxism regarding the topic of ideology. After the characterization of Habermasian thinking regarding the progress of instrumental rationality (at the expense of communicative reason) it confronts the debate between Habermas and Niklas Luhmann within German Social Theory. Finally, the third section focuses on showing the differences regarding the conception of the place of law in society, based on the theoretical frameworks of Habermas and Luhmann.

    Desafíos para la filosofía del derecho del Siglo XXI

    This paper shows a mismatch between a real and pressing demand for a philosophical analysis that allows us to explain the emergence of new phenomena in law, and the limited supply of theoretical tools to satisfy this demand by the traditional model of positivistic science of law. After an initial diagnosis of a mismatch between supply and demand, the resistance of legal positivism to accept practical rationality stands out as a core problem of the traditional model of positivistic science of law and the viability of this way of rationality is defended. The paper concludes with a proposal for the reinvention of the philosophy of law of the 21st century that incorporates new objectives and rethinks its method.
