As blockchain and NFT technologies continue to reshape the fashion landscape, this study explores their implications in the fashion ecosystem and the challenges they pose in terms of copyright.The article begins by exploring how NFTs enable fashion designers to authenticate their creations, providing a solution to counterfeiting and copying issues. Additionally, it emphasizes the NFTs’ capacity to track the ownership of digital assets, which can lead to greater control and compensation for fashion designers and artists.However, as the fashion industry delves into the world of NFTs, legal and ethical challenges emerge in relation to copyright. The existing challenges presented by fashion law are closely related to the legal specializations that are part of fashion law. For this, the author has chosen to deconstruct the different elements of the term, explaining each one of them. The deconstruction determines what is Law for the author, what is Fashion and the use of connectors. To specify the task, the Fashion industry and the meaning generated by the use of binding prepositions in the case of Fashion Law and Fashion Law are analyzed. Thoughts, definitions and opinions of the legal sector around the world are collected as an additional contribution. To that end, problems and solutions are addressed, such as the equality of sectoral regulations and the prohibition of incorporating different legal arguments in the administrative sphere. The importance of interpreting the administrative litigation process to enforce the rights of the administrators is highlighted. For this reason, the purpose of this article is to identify the legal framework under which the rights of fashion consumers are protected within electronic commerce. The fashion world not only studies problems with brands or designs, but also studies the problems that arise behind the catwalks, in the preparation of a garment or accessory, even in the way of marketing garments in the market textile. The sale of a garment would not be possible without the creative, technical, and professional capacity of designers or preparations. But how to design an attractive work environment? with ideal remuneration because it would generate greater competitiveness in the textile market.Ítem Texto completo enlazado Derecho de la Moda en el Perú(Pontificia Universidad Católica del Perú, 2023-12-29) Fasson Llosa, AnnaluciaEn Perú, el Derecho de la Moda y Retail comenzó a tomar forma hace más de 8 años, cuando el 13 de agosto de 2015 se inauguró la primera área de esta especialización en el estudio de abogados Muñiz, Olaya, Meléndez, Castro, Ono & Herrera. Este avance fue impulsado por el doctor Mauricio Olaya Nohra, quien promovió esta novedosa rama del derecho en el ámbito legal peruano. Con dedicación y esfuerzo, el 22 de agosto de 2022, el Colegio de Abogados de Lima, mediante la Resolución N° 093-2022-CAL/DCC, reconoció oficialmente al Derecho de la Moda como una especialización legal. Además, en 2018, el Estudio Muñiz lanzó el primer e-book sobre este tema en Perú, lo que ha llevado a que se enseñe en diversas universidades, como la Universidad de Lima y la ESAN. La especialización ha cobrado mayor relevancia, al punto de que la revista jurídica francesa Leaders League incluyó por primera vez a los abogados especializados en Derecho de la Moda en sus rankings anuales, impulsando a más profesionales a seguir este camino.Ítem Texto completo enlazado La decisión andina 876 - régimen común de marca país, norma pionera y vanguardista, que tendrá un impacto multilateral(Pontificia Universidad Católica del Perú, 2024-03-15) Suárez Mallqui, Lourdes MilagrosThe country Brand is a sign that many countries have today, however, it does not have recognition and protection at the multilateral level from the existing rules of Industrial Property, given this need the block of countries that make up the Andean Community, after several years of negotiation, has managed to approve the Andean Decision 876 on the Common Country Brand Regime, without a doubt this is a pioneering an highly avant-garde standard, which will have a multilateral impact in the coming years.This article analyzes the existing problems for the protection of a country brand, evidencing the need to have a specific regulation that recognizes and protects this sign, it also analyzes and comments on the most relevant aspects of the regulation contained in Andean Decision 876 and finally, it indicates what is the pending task in this matter, detailing the most important advances that have been made to date for the recognition and protection of the country brand before the World Intellectual Property Organization (WIPO), the highest international authority on the matter.
