Abstract

The author argues that the adaptability of forms is a mixed variant between the systems of legal formalism and informalism, and not strictly a guiding principle of the process. Thus, if incorporated into procedural systems, it would serve as a tool for the judge to better perform their creative and remedial functions in the process.

El autor defiende que la adaptabilidad de las formas es una variante mixta entre los sistemas de legalidad e informalismo y no propiamente un principio rector del proceso. Así, de incorporarse en los sistemas procesales, aquella serviría como herramienta al juez para que pueda desempeñar mejor su función creativa y sanadora del proceso.
