Los regímenes de responsabilidad administrativa de funcionarios y servidores públicos frente a posibles casos de corrupción: el rol sancionador de SERVIR y de la CGR

Abstract
El presente artículo académico analiza los regímenes de responsabilidad administrativa
de los funcionarios y de los servidores públicos frente a posibles actos de corrupción, ello
analizado desde el rol que cumple la Autoridad Nacional del Servicio Civil (en adelante,
SERVIR) y la CGR (en adelante, CGR).
Al respecto, se analizarán cuatro objetivos. El primero de ellos versará respecto a las
funciones de SERVIR y de la CGR en relación al ejercicio de la función pública, en otros
términos, se realizará un análisis del sistema disciplinario y del sistema sancionador
respectivamente. Sin perjuicio de ello, el segundo objetivo versará sobre la determinación
de las infracciones, pasibles de ser cometidos por los servidores civiles, los cuales están
consideradas en el catálogo de faltas administrado por SERVIR y la CGR, relacionados
a actos de corrupción. Respecto al tercer objetivo este versará sobre la propuesta de los
mecanismos a implementar por parte de SERVIR y la CGR para mejorar el combate a la
corrupción, desde el ámbito de la responsabilidad administrativa. Finalmente,
esbozaremos las conclusiones del presente artículo de investigación, ello en concordancia
de las propuestas y mejoras en la regulación de infracciones a cargo de SERVIR y CGR,
en relación a actos de corrupción.
This academic article analyzes the regimes of administrative responsibility of civil servants and public officials in the face of possible acts of corruption, analyzed from the perspective of the role of the National Civil Service Authority (SERVIR) and the Office of the CGR. In this regard, four objectives will be analyzed. The first one will deal with the functions of SERVIR and the Office of the CGR in relation to the exercise of the public function, in other words, an analysis of the disciplinary system and the sanctioning system, respectively, will be carried out. Notwithstanding, the second objective will deal with the determination of infractions, in the exercise of the public function, which are considered in the catalog of offenses administered by SERVIR and the CGR, related to acts of corruption of both public officials and civil servants. Regarding the third objective, this will deal with the proposal of mechanisms to be implemented by SERVIR and the CGR to improve the fight against corruption, from the scope of administrative responsibility. Finally, we will outline the conclusions of this research article, in accordance with the proposals and improvements in the regulation of infractions by SERVIR and the CGR, in relation to acts of corruption.
