Resumen
El plazo razonable se encuentra ligado al concepto del debido proceso y la tutela
jurisdiccional efectiva, a razón de que todo ser humano tiene derecho a ser oído
por un tribunal competente, con las garantías mínimas y dentro de un tiempo que
no denote la configuración de una victoria pírrica. El objetivo de la presente
investigación es responder si en el caso de la NLPT, los juzgados y salas
superiores de la CSJLIMA cumplen con el derecho al plazo razonable, durante
el periodo 2017-2021. El análisis de la investigación utiliza los criterios
jurisprudenciales establecidos por la Corte IDH, los dos parámetros propuestos
(el carácter alimentario del proceso laboral y la seguridad jurídica) y data
obtenida del ETII NLPT adscrita al Consejo Ejecutivo del Poder Judicial del Perú,
la Secretaría Técnica del ETII NLPT de la CSJLIMA y el Área de Administración
de las Salas Laborales – NLPT de la CSJLIMA. Estos elementos han permitido
identificar la vulneración del derecho al plazo razonable en dichas instancias
jurisdiccionales y dentro del periodo estudiado.
The reasonable term is linked to the concept of due process and effective jurisdictional protection, because every human being has the right to be heard by a competent court, with the minimum guarantees and within a time that does not denote the configuration of a Pyrrhic victory. The objective of the present research is to answer whether in the case of the NLPT, the courts and superior chambers of the CSJLIMA comply with the right to reasonable time, during the period 2017-2021. The analysis of the research uses the jurisprudential criteria established by the IACHR Court, the two proposed parameters (the alimentary nature of the labor process and legal certainty) and data obtained from the ETII NLPT attached to the Executive Council of the Judiciary of Peru, the Technical Secretariat of the ETII NLPT of the CSJLIMA and the Area of Administration of the Labor Chambers - NLPT of the CSJLIMA. These elements have made it possible to identify the violation of the right to reasonable time in these jurisdictional instances and within the period studied.
