Propuesta de Modificación a la Ley Orgánica de Hidrocarburos: avances y retrocesos

Abstract

En este artículo, sobre la base del ordenamiento jurídico vigente, así como las características y experiencia del upstream, se analiza las últimas propuestas de modificación de Ley Orgánica de Hidrocarburos, concluyendo que algunas se encuentran orientadas a dinamizar la industria, tales como, la extensión de los plazos contractuales de exploración y explotación, la modificación del régimen de regalías y la simplificación de tramitología. Sin embargo, también se concluye que existen iniciativas que generarían un desincentivo a la inversión privada, entre éstas las nuevas causales de terminación de los Contratos y la participación forzosa de Petroperú S.A. como socio. Asimismo, se analiza la propuesta de cláusula anticorrupción.

This article analyzes the latest proposals for the modification of the Hydrocarbons’ Organic Law, based on the legal system as well as the characteristics and experience in the Upstream, concluding that some of them are oriented to boost the investment in the industry, such as the extension of exploration and exploitation contractual terms, the modification of the royalty regime and simplification of the permitting burden. However, it is also concluded that there are some initiatives that would create a disincentive to private investment, as the new grounds for termination of the Contracts and the forced participation of the Petroperú S.A. as partner. Also, this article analyzes the proposal for anticorruption clause.
