La mora del acreedor y el pago por consignación en el derecho del Perú y Argentina

Abstract

The regulation of ‘arrears of the creditor’ and ‘payment by consignment’ is analyzed in the Peruvian Civil Code and in the Argentine Civil and Commercial Code, in this sense, it is possible to compare the requirements for the design, origin and effects of each of these figures in the prevailing legislation. This method allows to see the evolution of the connection between the institutions to visualize the possible solutions that perfect their harmonious assembly in the context of the 40th anniversary of the Peruvian Civil Code.El régimen de la ‘mora del acreedor’ y del ‘pago por consignación’ se estudia en el Código Civil del Perú y en el Código Civil y Comercial argentino, es posible así comparar los requisitos para la configuración, procedencia y efectos de cada una de estas figuras en la legislación vigente. Este método permite conocer la evolución del vínculo entre los institutos para visualizar las posibles soluciones que perfeccionen su armónico ensamble en el contexto de los 40 años aniversario del Código Civil del Perú.
