Los “Poderes Judiciales”, proceso y política judicial: una mirada desde el Estado Constitucional

Resumen
El autor sostiene que la función jurisdiccional unitaria en el Perú consiste en que solo el Estado tiene el poder de resolver conflictos, lo que no impide que sea ejercida por todo aquel auto-rizado por la Constitución (“Poderes Judiciales”). Esta tesis corre paralela a otra: por un lado, en el Estado Consti-tucional cabe hablar del Servicio Pú-blico de Justicia y ya no de la Adminis-tración de Justicia, puesto que el ciu-dadano es el protagonista; y, por otro, cabe reenfocar la política judicial en lo que concierne al proceso, dado su rol de instrumento esencial en la presta-ción del servicio.
The author maintains that the unitary judicial function in Peru entails that only the State has the power to resolve conflicts, which does not prevent it from being exercised by anyone authorized by the Constitution ("Judiciary Branches"). This thesis runs parallel to another: on one hand, in the Constitutional State it is possible to speak about the Public Service of Justice and no longer of the Admin-istration of Justice, since the citizen is the main character; and on the other hand, it is important to refocus on the judicial policy in regard to the process, given its role as an essential instru-ment in the provision of the service.
