La articulación entre el SIDH y la Constitución peruana de 1993: reglas restrictivas del Nuevo Código Procesal Constitucional

Abstract

This text critically analyzes Peru’s new Constitutional Procedural Code in light of the standards of the Inter-American Human Rights System, particularly regarding effective judicial protection, due process, and the principle of conventionality control. Through a pluralistic dialogue among different doctrinal positions, it examines key reforms such as the transfer of jurisdiction over habeas corpus, the regulation of preliminary dismissals, the express omission of collective amparo proceedings, and the restrictions introduced on the use of Inter-American Court jurisprudence. The analysis highlights the tensions between the pursuit of procedural efficiency and the requirement to guarantee real, timely, and effective access to constitutional justice, in accordance with Articles 8 and 25 of the American Convention on Human Rights.El texto analiza críticamente el Nuevo Código Procesal Constitucional peruano a la luz de los estándares del Sistema Interamericano de Derechos Humanos, particularmente en relación con la tutela judicial efectiva, el debido proceso y el control de convencionalidad. A partir de un diálogo plural entre distintas posturas doctrinales, se examinan reformas clave como el traslado de la competencia del hábeas corpus, la regulación del rechazo liminar, la omisión expresa del amparo colectivo y las restricciones introducidas al uso de la jurisprudencia de la Corte Interamericana. El análisis pone en evidencia las tensiones entre la búsqueda de eficiencia procesal y la exigencia de garantizar un acceso real, oportuno y efectivo a la justicia constitucional, conforme a los artículos 8 y 25 de la Convención Americana sobre Derechos Humanos.
