Concesiones Eléctricas: Una Propuesta Para Mejorar Su Financiamiento

Abstract

El autor explica a grandes rasgos el rol preponderante del sector privado en la inversión y ejecución de obras de infraestructura pública, y en la prestación de servicios públicos en nuestro país, con el objetivo de disminuir la brecha de infraestructura en diversos sectores como el de saneamiento, telecomunicaciones, energía, etc. En adición a lo anterior, considera que deben generarse herramientas eficaces que busquen favorecer el desarrollo de proyectos de los diversos sectores, como el otorgamiento de concesiones eléctricas en garantía a favor de los financistas privados para promover proyectos energéticos. En ese sentido, compara la regulación para el financiamiento de proyectos sujetos el régimen de APP y los sujetos al marco normativo del sector energía, para luego indicar que la hipotecaes una importante garantía para el financiamiento de un proyecto energético, a pesar de algunas deficiencias identificadas por el autor en la regulación vigente.
