Resumen
En el presente Artículo pretende resaltar la importancia de la necesidad de la regulación
de las Técnicas de Reproducción Asistida (TERAS) en nuestro país en base a una
investigación académica realizada respecto al desarrollo y evolución de estas TERAS, así
como su relevancia para que las personas que padecen de infertilidad puedan ejercer su
Derecho a la Reproducción, derecho que se pretende demostrar que está recogido por
nuestro ordenamiento. En ese sentido y desde un punto de vista de Derecho de Protección
al Consumidor, se va también a demostrar cómo es que este servicio médico es importante
para los consumidores que adquieren este servicio, en tanto que actualmente se viene
brindando por entidades públicas y privadas de salud. Esto a razón de un caso práctico
llevando ante INDECOPI, donde se trató acerca de la idoneidad de una de las TERAS,
esto es, la Fertilización in Vitro, en función a su propia naturaleza y además se señalará
la importancia de la uniformización de un formulario de consentimiento informado
cuando se adquiera este tipo de servicios.
