El Principio de Legalidad: Una aproximación desde el Estado Social de Derecho

Abstract

En la presente investigación se llevará a cabo un estudio del Principio de Legalidad en el Estado Social de Derecho, en el cual se realiza una crítica a la formulación clásica del mismo y se plantea un nuevo entendimiento de acuerdo a las exigencias que se desprenden desde la cláusula social y que en concreto afectan a la nueva Administración Pública Prestadora. Se plantea asimismo un entendimiento del principio de legalidad sobre la base del Estado de Derecho, pero que responde al nuevo papel que cumple la Administración Pública Prestadora. Se inicia con una aproximación clásica del mismo, una crítica y finalmente un acercamiento actual del mismo.This investigation will carry out a study of the Principle of Legality in the Social State of Law, in which a criticism is made of the classic formulation of the same and a new understanding is proposed per the requirements that follow from the social clause and which affect the new Lending Public Administration. An understanding of the principle of legality is also raised based on the rule of law, but which responds to the new role played by the Lending Public Administration. It starts with a classic approach to it, a critique and finally a current approach to it.
