La vivienda en la planificación urbanística española

Abstract

Housing in Spain is a Constitutional right established in article 47. Consequently, the Public Administration must adopt the appropriate legal measures to make this right effective. The modality applied by the Spanish Urban Development System is specified in reserving a part of the houses that the planning foresees in its urban development actions to a type of officially protected housing at appraised prices lower than those of the market, as well as the provision that a part of the urbanized land for residential use is given free of charge to the Administration to promote public protected housing. The article analyzes the characteristics of the System, as well as the experience lived in the years 98-2007 and the legal-urban framework currently in force.

La vivienda en España es un derecho constitucional establecido en su artículo 47. En consecuencia, la Administración pública debe adoptar las medidas legales oportunas para hacer efectivo ese derecho. La modalidad aplicada por el Sistema Urbanístico Español se concreta en reservar una parte de las viviendas que el planeamiento prevé en sus actuaciones urbanizadoras a un tipo de vivienda protegida oficialmente a precios tasados inferiores a los de mercado, así como también a la disposición de que una parte del suelo urbanizado para uso residencial se ceda gratuitamente a la Administración para promover vivienda protegida pública. En el artículo se analizan las características del Sistema, así como la experiencia vivida en los años 98-2007 y el marco jurídico-urbanístico vigente en la actualidad.
