El procedimiento acelerado de patentes (PPH) en el Perú: a 5 años de su implementación

Abstract

A través de este artículo, haremos un repaso histórico de cómo ha sido el proceso de implementación del Procedimiento Acelerado de Patentes en el Perú desde que se suscribió el primer memorando de entendimiento con la Oficina Española de Patentes en el año 2016 hasta la suscripción del acuerdo más reciente con la Oficina Europea de Patentes y de los resultados que este viene obteniendo desde su aplicación; asimismo, se intentará realizar un breve análisis jurídico de dicho mecanismo dentro del marco de la Decisión 486 que regula el Régimen Común sobre Propiedad Industrial de la Comisión de la Comunidad Andina con el objetivo de verificar si su aplicación contraviene la referida norma.Through this article, we will review the history of the implementation process of the PATENT PROSECUTION HIGHWAY (PPH) in Peru since the first memorandum of understanding was signed with the Spanish Patent Office in 2016 until the signing of the most recent agreement with the European Patent Office and the results that it has been obtaining since its application; likewise, an attempt will be made to carry out a brief legal analysis of said mechanism within the framework of Decision 486 that regulates the Common Regime on Industrial Property of the Andean Community Commission in order to verify whether its application contravenes the aforementioned Decision.
