Abstract
En el presente trabajo el autor se vale de la explicación de la narración fáctica-jurídica como requisito de la demanda, el hecho esencial y secundario, el contenido de la causa petendi, la posibilidad de la recalificación jurídica de la demanda y la violación al principio de no sorpresa, para señalar que no nulidad cuando la manifestación de la parte que no fue oída no pueda influenciar en el resultado de la causa o cuando la decisión le fuera favorable, en razón a los principios de la duración razonable y de la economía procesal.
In this paper the author uses the explanation of the factual-legal narrative as a requirement of the claim, the essential and secondary fact, the content of the causa petendi, the possibility of the alteration of the legal issues of the claim, and the violation of the principle of no surprise, to point out that it is not possible to speak of nullity of the procedure when the manifestation of the party that was not heard, cannot influence the outcome of the case or when the decision was favorable, due to the principles of reasonable and procedural economy.
