Simplificación regulatoria: la necesaria distinción entre normar y administrar

Abstract

Three bills are currently under discussion in the Chilean Congress, all with the common goal of simplifying regulation. These bills propose the creation of three agencies: (i) the Office of Sectoral Authorizations and Investment; (ii) the Committee of Undersecretaries for Regulation and Sectoral Evaluation; and (iii) the Agency for the Quality of Public Policies and Productivity. In light of these legislative proposals and the limited conceptualization of the subject, both nationally and internationally, this article aims to propose a conceptual framework for regulatory simplification, distinguishing between normative and administrative simplification, and offering recommendations for its more effective implementation.

Actualmente, se discuten tres proyectos de ley en el Congreso de Chile que tienen como objetivo común simplificar la regulación, proponiendo conjuntamente, la creación de tres entidades: (i) la Oficina de Autorizaciones Sectoriales e Inversión; (ii) el Comité de Subsecretarias y Subsecretarios para la Regulación y Evaluación Sectorial; y (iii) la Agencia para la calidad de las Políticas Públicas y la Productividad. A propósito de estos proyectos de Ley y la escasa conceptualización en la materia, tanto nacional como en la experiencia comparada, el presente artículo tiene como finalidad proponer una conceptualización de la simplificación regulatoria, distinguiendo entre simplificación normativa y administrativa y formulando recomendaciones para su mejor implementación.
