“Protección de los Activos Intangibles dentro del Derecho de Inversiones en Honduras”

Abstract

This article examines the protection framework Honduras provides to investors holding intellectual property rights classified as “intangible assets.” In 2023 and 2024, Honduras faced multiple claims before ICSID for alleged violations of these rights. The analysis begins with a study of legal norms protecting Intellectual Property under Investment Law, as established in international treaties and national legislation. It then explores the role of key institutions ensuring this protection. Finally, it discusses the challenges investors face in securing privileged rights over their Intellectual Property or pursuing legal actions against infringements.

Este artículo analiza el marco de protección que Honduras brinda a inversionistas con derechos intelectuales considerados “activos intangibles”. En 2023 y 2024, el Estado hondureño enfrentó múltiples reclamaciones ante el CIADI por presuntas violaciones a estos derechos. El análisis inicia con el estudio de normas jurídicas que protegen la Propiedad Intelectual desde el Derecho de Inversiones, tanto en tratados internacionales como en legislación nacional. Luego, se examina el rol de las instituciones que garantizan esta protección. Finalmente, se abordan los retos para inversionistas que buscan el reconocimiento de derechos privilegiados sobre su Propiedad Intelectual o el ejercicio de acciones legales contra infracciones.
