Racionalizar la vacancia presidencial por la causal de incapacidad moral permanente

Abstract

This article deals with the figure of the presidential vacancy due to the cause of permanent moral incapacity. In this sense, it maintains that it operates, in fact, as a kind of informal political trial due to the limitations of article 117 of the Constitution that prevents that the president could be accused during his mandate outside of four extraordinary assumptions. Thus, it proposes that if it is not possible to amend the Constitution on this point, it is decided to rationalize the presidential vacancy in order to respect the right to due process of the president, and limit the discretion of the Congress.

El presente artículo trata sobre la figura de la vacancia presidencial por la causal de incapacidad moral permanente. Así, sostiene que en los hechos ésta opera como una suerte de juicio político informal a causa de las limitaciones, que posee el artículo 117 de la Constitución, que impide acusar al presidente durante su mandato fuera de cuatro supuestos extraordinarios. En ese sentido, plantea que —en caso no sea posible reformar la Constitución en este extremo— se opte por racionalizar la vacancia presidencial con el objeto de que se respete el derecho al debido proceso del presidente, y se limite la discrecionalidad del Congreso de forma razonable.
