Intangibles e inteligencia artificial: Una visión desde los derechos humanos en México

Abstract

The text examines the relationship between three key institutions: intellectual property, artificial intelligence, and human rights. In a legal context of state obligations, it discusses the protection of rights for individuals in Mexico, users of 4.0 technologies, and the legal uncertainty regarding the recognition of their intellectual creations. It explores the principles of intellectual property and its link to artificial intelligence, understood as the ability of machines to imitate human intelligence. Legal frameworks in Mexico and globally are discussed, linking them to human rights, concluding with the study of human control as an emerging but applicable right.

El texto analiza la relación entre tres instituciones clave: propiedad intelectual, inteligencia artificial y derechos humanos. En un contexto jurídico de obligaciones estatales, se aborda la protección de los derechos de las personas en México, usuarias de tecnologías de la revolución 4.0, y la incertidumbre jurídica sobre el reconocimiento de sus creaciones intelectuales. Se exploran los principios de la propiedad intelectual y su conexión con la inteligencia artificial, entendida como la capacidad de las máquinas para imitar la inteligencia humana. Se mencionan los marcos legales en México y globalmente, vinculándolos a los derechos humanos, y se concluye con el estudio del control humano como un derecho emergente pero aplicable.
