Medidas restrictivas del ejercicio de derechos preexistentes de aprovechamiento de recursos naturales en áreas naturales protegidas: ¿expropiación regulatoria o carga legítima?

Abstract

El objetivo principal de este artículo es repensar el riesgo que enfrenta el ejercicio de derechos y títulos habilitantes de aprovechamiento de recursos naturales frente a la normativa de creación y gestión de áreas naturales protegidas que les afecta. En ese sentido, el artículo analiza los conceptos de expropiación regulatoria, así como de rezago regulatorio en materia ambiental, para proseguir a examinar las diferentes medidas administrativas de la gestión de áreas naturales protegidas frente a las inversiones. Finalmente se profundiza en la necesidad de contar con un procedimiento efectivo de compensación cuando las medidas regulatorias ambientales constituyan una expropiación indirecta.The main objective of this article is to rethink the risk that natural resources exploitation rights and titles face in front of the rules of creation and management of protected natural areas that affect them. In this sense, the article analyzes the concepts of the regulatory expropriation as well as a regulatory lag in environmental matters, to pursue the concrete examination of whether the different administrative measures for the management of protected natural areas affects the protection of investments according the international protection standard. Finally, it is reviewed the challenges to obtain an effective compensation when the environmental regulatory measures become an indirect expropriation.
