Abstract
A través de este estudio se busca analizar el marco constitucional y
legal referido a la regulación del derecho a rehusarse (decir no) por parte de los
trabajadores ante la presencia de condiciones sub estándares en su entorno
laboral, así como analizar el grado de conocimiento y ejercicio del referido derecho
por parte de los trabajadores con especial énfasis, teniendo en cuenta las
particularidades de la actividad y el grado de instrucción de los trabajadores de
construcción civil.
Se plantea la necesidad de que el trabajador cuente con una certificación en
materia de seguridad y salud en el trabajo o que la certificación de competencias
laborales comprenda aspectos en seguridad y salud en el trabajo, como parte de
los requisitos para la inscripción del trabajador ante el Registro de trabajadores en
construcción civil – RETCC.
This study seeks to analyze the constitutional and legal framework referred to the regulation of workers' right to refuse (say no) to the presence of substandard conditions in their work environment, as well as to analyze the degree of knowledge and exercise of the said right by the workers with special emphasis, taking into account the particularities of the activity and the education level of the civil construction workers. The need for the worker to have a certification in the field of occupational safety and health or for the certification of labor competencies to include occupational health and safety aspects as part of the requirements for worker registration of workers in civil construction - RETCC.
