Abstract
En esta investigación el autor explica la importancia de la técnica anticipatoria en el sistema jurídico, destacando que proporciona al operador del derecho una aproximación entre el derecho procesal y el derecho material. Finalmente, señala que la técnica anticipatoria será posible solo cuando la isonomía y el acceso a la justicia recomienden la flexibilización de la seguridad de la cognición completa.
In this research, the author explains the importance of the summary injunction in a legal system, pointing out that it provides the legal user an approximation between procedural law and material law. Finally, it is emphasized that the anticipatory technique will be possible only when isonomy and access to justice recommend the flexibilization of the legal certainty of full cognition on the merits.
