El responsable civil en el proceso penal

Abstract

The author concludes that the recognition of the “civilly liable party”, invoked by Peruvian criminal jurisprudence in recent years, as a procedural party in Peruvian criminal proceedings, is derived from the provisions of article 111 of the Code of Criminal Procedure. And she argues that it is important to differentiate the civilly liable party from the civilly liable third party, since it is frequent that in the criminal proceedings these institutions are confused; supporting, for example, the incorporation and liability of the civilly liable party with the rules that govern the civilly liable third party, despite the fact that they are institutions with different nature, rules and legal consequences.

La autora analiza el reconocimiento del “responsable civil”, invocado por la jurisprudencia penal peruana en los últimos años, como parte procesal en el proceso penal peruano y concluye que este reconocimiento se desprende de lo establecido en el artículo 111 del Código Procesal Penal. Además, sostiene que es importante diferenciar al responsable civil del tercero civilmente responsable, pues es frecuente que en el proceso penal se confundan dichas instituciones; sustentando, por ejemplo, la incorporación y responsabilidad del responsable civil con las reglas que rigen al tercero civilmente responsable, a pesar de que son instituciones con naturaleza, reglas y consecuencias jurídicas diferentes.
