Abstract
En el actual mercado de publicidad online los agentes económicos buscan desviar la demanda de los consumidores hacia sus ofertas a través del uso de publicidad programática. Una de las más persuasivas y efectivas es el uso de Google Ads. En el presente artículo analizaremos si el uso de marcas de terceros competidores como keywords en dicha plataforma constituyen actos de competencia desleal o infracción marcaria.
In the current online advertising market, economic operators seek to divert demand of consumers to their offers through programmatic advertising. One of the most persuasive and effective is Google Ads. In this article, we shall analyse whether the unauthorized use of third-party trademarks as keywords on “Google Ads” constitute an act of unfair competition or a trademark infringement.
