Abstract
En las relaciones de consumo, no solo el proveedor debe cumplir con las
obligaciones que se indican en el Código de Protección y Defensa del
Consumidor y otras normas, sino que el consumidor debe cumplir con la
contraprestación económica que se estableció.
Ahora, en una relación de consumo con universidades privadas, se espera que
el alumno cumpla con pagar la totalidad de sus cuotas porque esta es la fuente
directa que tienen estas instituciones para generar ingreso.
El problema surge cuando existen alumnos que tienen problemas de pago,
algunos incluso no cumplen con la obligación de pago y, a pesar de las gestiones
de cobro no es posible recuperar el monto adeudado. El problema se agrava
para las universidades debido al artículo 2 de Ley de Protección de Economía
Familiar del pago de pensiones en institutos, escuelas superiores, universidades
y escuela de posgrado públicos y privados – Ley N° 29947 ya que el servicio
educativo debe brindarse de forma idónea, sin importar que pueda existir cuotas
de pago vencidas. Las universidades privadas se encuentran en una posición de
desventaja ya que, en algunos casos, el alumno se retira de la institución
educativa y, por consiguiente, el pago dependerá de la responsabilidad del
consumidor.
El objetivo principal del presente trabajo es determinar si el proveedor también
necesita de protección en los casos que el consumidor no cumpla con su
obligación, ello en tanto que la falta de pago también afecta a las universidades
y a todos aquellos que dependan de ella.
In consumer relations, not only must the supplier comply with the obligations indicated in the Consumer Protection and Defense Code and other regulations, but the consumer must comply with the economic consideration that was established. Now, in a consumer relationship with private universities, the student is expected to pay all of their fees because this is the direct source that these institutions have to generate income. The problem arises when there are students who have payment problems, some even do not comply with the payment obligation and, despite the collection efforts, it is not possible to recover the amount owed. The problem is aggravated for universities due to article 2 of the Family Economy Protection Law of the payment of pensions in public and private institutes, higher schools, universities and postgraduate schools - Law N°29947 since the educational service must be provided in a manner ideal, regardless of whether there may be overdue payment installments. Private universities are in a disadvantageous position since, in some cases, the student withdraws from the educational institution and, consequently, payment will depend on the responsibility of the consumer. The main objective of this work is to determine if the supplier also needs protection in cases where the consumer does not comply with his obligation, while non-payment also affects universities and all those who depend on them.
