Abstract
El autor ingresa en el mundo del Compliance para analizar con rigurosidad algunos de sus aspectos menos estudiados, como su fundamento, naturaleza, el potencial de la enconomía conductual para optimizarlo; eslabonarlo en el sistema conceptual regulatorio, aclarando que no constituye la privatización de potestades públicas. De forma novedosa indica que la regulación y el Compliance están destinados a mitigar riesgos, bajo una lógica de cuasi co-regulation, por lo que sitúa al Compliance como la respuesta más reciente, del Derecho y la regulación, a la incertidumbre producida por la Sociedad del Riesgo, destacando su utilidad en el contexto del COVID-19.
The author enters the world of compliance to rigorously analyze some of its lesser known aspects, such as its foundation, nature, and the potential that behavioral economics has to optimize it; link it in the conceptual regulatory system, clarifying that it does not constitute the privatization of public powers. In a novel fashion, it indicates that regulation and compliance are intended to mitigate risks in society, under a premise of quasi-co-regulation, which is why compliance is the most recent response, from law and regulation, to the uncertainty produced by the Risk Society, highlighting its usefulness in the context of COVID-19.
