Abstract
En el presente trabajo el autor trata el tema del abuso del proceso, mostrando dudas y perplejidades sobre la posibilidad de que existan supuestos atípicos de abuso, tal como viene asentándose en buena parte de la doctrina y de la jurisprudencia italianas. En ese sentido, el autor advierte que bajo el lema moralizador del “abuso del proceso” se esconde una “deriva autoritaria”, la cual, con la excusa de privilegiar los “valores del sistema”, en el fondo, limita la libertad de acción de las partes.
In this essay the author deals with the topic of the abuse of process, showing his doubts and perplexities about the possibility of the existence of atypical hypothesis of abuse of process, as it is occurring in Italian legal doctrine and judicial decisions nowadays. In that sense, the author warns that under the moralizer slogan of “abuse of process” it is hiding an “adrift authoritarian” that, with the excuse of favoring the “values of the system”, actually limits the liberty of action of the parties.
