Resumen
Las disciplinas de competencia desleal y propiedad industrial, más allá de regular comportamientos diferentes y diferenciables, tutelan intereses jurídicos también disímiles. Por un lado, tenemos la protección dispensada, a título monopólico, a derechos intelectuales de aplicación industrial y, por el otro, está la protección al adecuado funcionamiento concurrencial del mercado mediante la observancia de las reglas generales de buena fe y usos honestos en el mercado. A pesar de las marcadas diferencias entre uno y otro sistema, ello no impide ni mucho menossignifica que ambos regímenes compartan entre sí algunas nociones normativas, tanto a nivel sustancial como en el plano procesal. Algunos ejemplos de esta aparente unidad conceptual entre uno y otro régimen son las nociones de “confusión” y de “reputación” que en algunos casos, y con variados matices, son regladas y desarrolladas harto diferente, según el sistema normativo aplicable. El objetivo de este documento es el de identificar los conceptos a partir de sus definiciones, contrastando las diferencias en uno y otro sistema jurídico.
The disciplines of unfair competition and industrial property, beyond regulating different and differentiable behaviors, protect also dissimilar legal interests. On the one hand, we have the protection provided on a monopoly basis to intellectual rights of industrial application and on the other there is the protection of the proper concurrent functioning of the market through the observance of the general rules of good faith and honest uses in the market. Despite the marked differences between one system and the other, this does not mean that both regimes share some normative notions with each other both at the substantial level and at the procedural level. Some examples of this apparent conceptual unity between one regime and the other are the notions of “confusion” and “reputation” that in some cases and with various nuances, are regulated and developed quite differently according to the applicable regulatory system. The objective of this document is to identify the concepts based on each´s definitions, contrasting their differences in both legal systems.
