Abstract
El documento expone y analiza la problemática recurrente que se ha venido presentando en los casos en que, durante los procesos de promoción de la inversión privada, el Estado ha hecho entrega de Estudios de Ingeniería a gran nivel de detalle. Por ejemplo, los Estudios Definitivos de Ingeniería o Estudios de Factibilidad; en donde con posterioridad a la suscripción de los Contratos de Concesión, se han identificado que dichos documentos presentan deficiencias que requieren ser subsanadas a fin de que se permita la ejecución de la infraestructura vial, en condiciones seguras para los usuarios, así como el cumplimiento de los niveles de servicio exigidos en el mismo Contrato de Concesión.Dicho análisis se realiza teniendo en consideración el marco jurídico de las Asociaciones Público Privadas, así como los principios y normas que rigen nuestro sistema contractual; para posteriormente revisar de forma sucinta la reciente publicación de los Lineamientos para la Asignación de Riesgos en los Contratos de Asociaciones Público – Privadas.
The paper describes and analyzes the recurring problem that has appeared in cases where, during the bidding process, the Government has brought to the private investors detailed Engineering Studies, as for example, Definitive Engineering Studies and Feasibility Studies; where after the signing of the Concession Contract, it has been identified that these documents have flaws that need to be corrected so that the execution of road infrastructure, in safe conditions for users, is allowed and also the compliance of service levels required in the Concession Contract.This analysis is done taking into consideration the legal framework for Public Private Partnerships, as well as the principles and rules governing our contractual system; for later have a brief review to the recent publication of the Guidelines for Assigned Risk Contracts for Public - Private Partnerships.
