Resumen
El ordenamiento jurídico pesquero nacional ha evolucionado adaptándose hacia mecanismos de manejo sostenible de los recursos hidrobiológicos; sin embargo, esta evolución se ha limitado principalmente a pesquerías que han demostrado signos de deterioro y que son aprovechadas por la flota industrial. La mayoría de pesquerías artesanales y de menor escala no han sido aún materia de evaluación y regulación en este sentido, a pesar de la evidencia del crecimiento desmedido que ha sufrido esta flota entre 1997 y 2015, y el impacto negativo que ello implica.La adopción de mecanismos que permitan mejorar la eficiencia en el aprovechamiento de los recursos marinos no debe esperar a que se presenten señales de alarma o deterioro en los mismos, sino se deberían implementar en tanto estos no se presenten, y considerando incentivos adecuados para que los actores asuman un compromiso con el desarrollo de una actividad, y a su vez ello permita un adecuado dimensionamiento del esfuerzo extractivo.
The national fisheries legal system has evolved, adapting towards mechanisms for the sustainable management of marine resources; however, this evolution has been limited mainly to fisheries that have shown signs of deterioration and that are exploited by the industrial fleet. Artisanal fisheries have not yet been subject to evaluation and regulation in this regard, despite the evidence of the excessive growth that this fleet has suffered between 1995 and 2012, and the negative impact that this implies.The adoption of mechanisms that allow improving the efficiency in the use of marine resources should not wait for warning signs or deterioration but should be implemented as long as they do not occur, and considering adequate incentives for the individuals who have access to them, so they can assume a commitment to the development of the activity, and in turn this allows an adequate dimensioning of the extractive effort.
